Court Case Public Hearing Overview
Note: This is NOT the Public Hearing with the Board of County Commissioners regarding the rezoning of the Homestead from residential to commercial. That has yet to be scheduled.
The Immediate Possession Hearing will be public and held at the Douglas County District Court in Castle Rock. It is scheduled for November 30, 2026, and will continue through the morning of December 1, 2026.
The Roxborough Park Foundation and the Arrowhead Colorado Metropolitan District (Pomeroy) have agreed on a schedule for the first phase of their court case. This schedule is called a Case Management Order, and it basically lays out the deadlines and steps both sides must follow as the lawsuit moves forward.
This phase focuses on two things:
Whether the Metro District should be given “immediate possession” of the easements it wants to take.
Whether the Metro District’s condemnation request is legally valid.
To prepare for the hearing, both sides will exchange information, take depositions, and complete other required legal steps.
The Foundation’s Board will continue updating the community when possible, keeping in mind that some information must remain confidential due to the ongoing litigation.

SOR Summary
Several neighbors have asked whether Pomeroy’s new partnership for a spa project in downtown Denver means they are no longer interested in building anything in Roxborough Park. The honest answer is: we don’t know. Nothing has been communicated to us that confirms a change in their plans.
We’ve also been asked what will happen at the public hearing on November 30 and December 1, 2026. At this point, all we know is that the hearing will focus on the issues already described — whether the Metro District can take immediate possession of the easements and whether its condemnation request is legally valid.
While anyone can speculate, that wouldn’t be helpful. Our goal is simply to keep the community informed about the actual status of the situation, whether it involves a proposed commercial resort spa or the possibility of multi‑family or single‑family housing within Roxborough Park on the Homestead parcel, surrounded by Arrowhead Golf Course.
